1. Acceptance of Terms

By downloading, installing, or using TripBoard, developed by Gizmo Labs LLC ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

TripBoard is a mobile application developed by Gizmo Labs LLC that helps users:

  1. Plan and organize trips

  2. Track travel expenses locally on their device

  3. Convert currencies using real-time exchange rates

  4. Analyze spending patterns

  5. Export financial data

Important: All your personal trip and expense data is stored locally on your device. We do not store your personal information on our servers.

3. License and Use

3.1 License Grant

Gizmo Labs LLC grants you a limited, non-exclusive, non-transferable, revocable license to use TripBoard for personal or business use in accordance with these Terms.

3.2 Permitted Use

You may use the App to:

  1. Create and manage your own trip and expense data on your device

  2. Use features according to your subscription tier

  3. Export your data for personal or business use

  4. Access currency conversion services

3.3 Prohibited Use

You may NOT:

  1. Reverse engineer, decompile, or disassemble the App

  2. Rent, lease, sell, or sublicense the App

  3. Remove or modify any proprietary notices

  4. Use the App for illegal purposes

  5. Attempt to bypass subscription or payment systems

  6. Upload malicious code or viruses

  7. Use the App in a way that harms our systems or other users

  8. Attempt to access our exchange rate database directly

4. Account and Data

4.1 Your Responsibility

You are responsible for:

  1. Maintaining the security of your device

  2. All activity under your account

  3. Accuracy of data you enter

  4. Backing up your data (though we provide iCloud sync as an optional feature)

4.2 Data Ownership

You retain full ownership of your trip and expense data. Since this data is stored on your device, you have complete control over it.

4.3 Our Data

Gizmo Labs LLC maintains a database of currency exchange rates to provide conversion services. This data belongs to us and contains no personal information.

5. Subscriptions and Payments

5.1 Premium Subscription

  1. Features require a paid subscription

  2. Subscriptions are processed through the Apple App Store

  3. Pricing is displayed in the app and App Store

  4. Subscriptions auto-renew unless cancelled before renewal date

5.2 Cancellation

  1. You can cancel your subscription anytime through your Apple App Store account settings

  2. Cancellation takes effect at the end of the current billing period

  3. No refunds for partial subscription periods

5.3 Refunds

  1. Refund requests are subject to Apple's refund policy

  2. Contact Apple Support for refund inquiries

  3. We may offer refunds at our discretion for service failures

5.4 Free Trial

  1. New subscribers may receive a free trial period

  2. You will be charged when the trial ends unless you cancel

  3. One free trial per user

  4. Trial duration is specified at time of subscription

6. Currency Conversion Disclaimer

6.1 Exchange Rates

  1. Exchange rates are provided by third-party data providers and stored in our database

  2. Rates are for informational purposes only

  3. We do not guarantee accuracy or real-time updates

  4. Rates may differ from actual transaction rates at banks or merchants

  5. We update rates regularly but cannot guarantee constant availability

6.2 No Financial Advice

TripBoard is a tracking tool only. We do not provide:

  1. Financial advice

  2. Tax guidance

  3. Investment recommendations

  4. Professional accounting services

For financial decisions, consult qualified professionals.

7. Service Availability

7.1 App Functionality

The core app functions work offline since data is stored on your device. However, some features require internet connectivity:

  1. Currency rate updates

  2. Location services

  3. iCloud sync

  4. Subscription management

7.2 Exchange Rate Service

We strive to maintain reliable currency conversion services but cannot guarantee:

  1. Constant availability of exchange rate updates

  2. Real-time accuracy of all currency pairs

  3. Uninterrupted service during maintenance

8. Intellectual Property

8.1 Our Rights

TripBoard and all associated content, features, and functionality are owned by Gizmo Labs LLC and protected by copyright, trademark, and other intellectual property laws.

8.2 Trademarks

"TripBoard" and associated logos are trademarks of Gizmo Labs LLC. You may not use them without written permission.

8.3 Feedback

If you provide suggestions or feedback, we may use it without obligation or compensation to you.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

The App is provided "as is" without warranties of any kind. We do not guarantee:

  1. Uninterrupted or error-free service

  2. Accuracy of currency data

  3. Compatibility with all devices

  4. Availability of third-party services

9.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  1. Loss of data stored on your device

  2. Indirect, incidental, or consequential damages

  3. Currency conversion errors or financial losses

  4. Damages exceeding the amount you paid for the subscription

9.3 Data Responsibility

Since your personal data is stored on your device, you are responsible for:

  1. Device security and backups

  2. Data loss due to device failure

  3. Accidental deletion of data

10. User Conduct

You agree to:

  1. Use the App lawfully and ethically

  2. Respect intellectual property rights

  3. Not interfere with the App's operation or our exchange rate services

  4. Not upload harmful content

  5. Comply with applicable laws and regulations

11. Third-Party Services

The App integrates with third-party services (Apple Maps, Firebase, RevenueCat, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

12. Modifications to Service

We reserve the right to:

  1. Modify or discontinue features

  2. Change subscription pricing with notice

  3. Update the App with new features or fixes

  4. Suspend currency rate services for maintenance

  5. Update exchange rate data sources

We will provide reasonable notice for significant changes affecting core functionality.

13. Termination

13.1 By You

You may stop using the App at any time and delete it from your device. This will remove all your local data.

13.2 By Us

We may terminate or suspend your access if you:

  1. Violate these Terms

  2. Engage in fraudulent activity

  3. Abuse or harm the service

  4. Fail to pay subscription fees

13.3 Effect of Termination

Upon termination:

  1. Your license to use the App ends

  2. You should delete the App from your devices

  3. Subscriptions continue until the end of the billing period

  4. Your local data remains on your device until you delete the app

14. Indemnification

You agree to indemnify and hold Gizmo Labs LLC harmless from any claims, damages, or expenses arising from:

  1. Your use of the App

  2. Your violation of these Terms

  3. Your violation of any law or third-party rights

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law provisions.

15.2 Arbitration

Any disputes shall be resolved through binding arbitration rather than court, except:

  1. Small claims court disputes

  2. Intellectual property disputes

  3. Injunctive relief requests

15.3 Class Action Waiver

You agree to resolve disputes individually, not as a class action.

16. General Provisions

16.1 Entire Agreement

These Terms constitute the entire agreement between you and Gizmo Labs LLC regarding the App.

16.2 Severability

If any provision is found invalid, the remaining provisions remain in effect.

16.3 Waiver

Failure to enforce any right does not waive that right.

16.4 Assignment

You may not assign these Terms. We may assign them to a successor or affiliate.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

17. Updates to Terms

We may update these Terms from time to time. Changes will be effective when posted. Continued use indicates acceptance of updated Terms. Significant changes will be notified through:
